What is Sexual Abuse?

Sexual abuse is the performance of any unwanted or non-consensual sexual acts against another person. Sexual abuse can be committed against minors who lack the ability to consent or adults whose consent was not freely given. Threats or other forms of coercion causing someone to perform sexual acts they do not want to commit is also a form of abuse.

Sexual abuse can take many forms. At the Halpern Law Firm, we’ll help you hold abusers to task for any form of abuse, including:

  • Non-consensual hugging or kissing
  • Sexual groping
  • Rape, attempted rape, and statutory rape
  • Physical molestation or sexual assault
  • Sexual assault of a minor
  • Unwanted violent sexual activity
  • Sexual abuse of the elderly

Child Sexual Abuse

There is perhaps no more heinous act than sexually abusing a child. Our sexual abuse attorneys fight to protect children who have been subjected to sexual conduct, as well as adults who survived sexual abuse as a child. California law permits people who were sexually abused as children to file a civil suit until either they turn 40 or until five years have passed since they discovered that they suffered psychological harm due to sexual abuse as a child, whichever comes later.

At the Halpern Law Firm, we fight for the rights of abuse survivors against any and all perpetrators, including:

  • School teachers, administrators, or other officials
  • Priests and other clergy members, including claims against religious institutions
  • Sports coaches and other recreational activity administrators
  • Youth organization leaders and officials
  • Foster care officials
  • Parents, uncles, grandparents, or other family members

Criminal Abuse Cases and Civil Cases Are Separate

If you’ve been subjected to sexual assault or sexual abuse, the perpetrator likely committed a crime. If the assault happened in the home, get yourself and your children to a safe place. Regardless, you should report the incident to the police as soon as possible. The perpetrator could be arrested and charged with a crime.

Whether you pursue a civil personal injury case against the perpetrator is an entirely separate issue from criminal prosecution. You can pursue a civil case before, during, or after the criminal case, even while the perpetrator is in prison. Even if the police decide not to charge the perpetrator because, for example, they do not believe they can build a criminal case, you can and should still pursue your civil claims. Criminal liability has a much higher standard of proof than civil liability–the prosecutor must be able to show that the defendant is guilty beyond a reasonable doubt. Even if the prosecutor cannot prove that level of guilt, you and your personal injury lawyer may still be able to show by a preponderance of the evidence that the defendant assaulted you.

If the defendant is convicted for their abuse, however, that conviction can serve as definitive proof that they are also liable in civil court. Talk to your civil abuse lawyer about your circumstances to find out when and how you should bring a civil claim for damages to get the compensation you deserve.
